Can I use Georgia’s renewal statute more than once for the same case?


Repeated use of Georgia’s renewal statute is limited. Once the original limitation period has expired, the privilege of renewing a dismissed case can be exercised only one time, so a plaintiff generally cannot keep dismissing and refiling the same claim indefinitely.

The one-time limit after expiration

O.C.G.A. § 9-2-61 allows a timely-filed case that is dismissed to be recommenced within the original period or within six months of the dismissal, whichever is later. The statute also draws a line on repetition. If the dismissal or discontinuance occurs after the applicable limitation period has expired, the privilege of renewal may be exercised only once. In other words, once a claimant is relying on the six-month renewal window because the original deadline has passed, that renewal is a single use.

The reason is straightforward. The renewal statute is a one-time grace mechanism for a valid case that ended without a merits decision, not a device for endlessly resetting the clock through serial dismissals.

How the limit plays out

The interaction with the original deadline determines what is left available:

  • While the original limitation period is still open, a dismissed case can be refiled within that remaining period as an ordinary timely action.
  • A renewal taken after the original period has expired uses up the single post-expiration renewal privilege.
  • A second dismissal after the period has run generally cannot be renewed again, because the one-time privilege has already been spent.
  • Each renewal must independently satisfy the statute, including timeliness, validity of the prior suit, and payment of costs.

Because the post-expiration renewal is a one-shot opportunity, a plaintiff who has already renewed once after the deadline passed has little room for further procedural missteps. The second-chance window is exactly that, a second chance and not a recurring one.

The bottom line

Georgia’s renewal statute permits only a single renewal once the original limitation period has expired. A claim can be refiled within a still-open original period as a normal timely suit, but the post-deadline renewal privilege under O.C.G.A. § 9-2-61 is used up after one use, so serial dismissal and refiling of the same case is not a viable strategy.
